Habitual residence: the declaration to renew with every permit

When you renew your residence permit you have sixty days to tell the municipality. If you do not, six months after expiry they can remove you from the registry: but they must warn you first, and from that moment you have thirty days to put it right.

There is one obligation almost nobody knows about, and skipping it can cost you your registered residence without you having done anything wrong: every time you renew your residence permit you must go back to the municipality and renew your declaration of habitual residence.

It is not a long procedure: it is a declaration, with a copy of the new permit attached. But it has to be done, and it has a deadline.

The rule, in two lines

Article 7(3) of the registry regulation — presidential decree 223/1989, this part written by article 15 of presidential decree 394/1999 — states that a foreign citizen registered with the municipality must renew the declaration of habitual residence at the registry office within sixty days of the renewal of the residence permit, together with the permit itself.

In plain words: when you collect your new permit, you have two months to tell the municipality "I am still here, and this is my renewed permit".

Why the rule exists

For an Italian citizen residence needs no confirmation: once registered, always registered. For a non-EU citizen registration is instead tied to the lawfulness of the stay, and the municipality has no way of knowing on its own that you renewed your permit. You have to tell them.

From the outside it looks like red tape. From the inside it is the thing that holds your residence up — and with it your identity card, your certificates, your family doctor, your children's school enrolment.

What happens if you do not renew it

Article 11(1)(c) of the same regulation provides for cancellation from the registry for failure to renew the declaration, six months after the expiry of the residence permit or residence card.

But — and this is the part that matters — the cancellation is not automatic. The same provision makes it conditional on a notice from the office, inviting you to act within the following thirty days.

So the real sequence is:

  1. your permit expires;
  2. six months pass without you renewing the declaration;
  3. the municipality writes to you, usually by registered post, inviting you to act;
  4. from the day you receive that letter you have thirty days;
  5. only if you do nothing does the cancellation go ahead.

Do not ignore that letter. It is the last step where fixing things costs a photocopy and an hour of queueing; afterwards it costs a whole new registration, with every check done again from scratch.

If you read "one year", you are reading an old page

Until 2009 the term was one year. Article 1(28) of law no. 94 of 15 July 2009 reduced it to six months. Forms and municipal pages with the old deadline are still circulating online: what applies today is six months.

The safety net: if you are waiting for the renewal

This is the question everybody asks, and it has the most reassuring answer. If you have filed the renewal application and are still waiting for the new permit — which in many police headquarters takes months — you do not lose your registration.

The Ministry of the Interior put it in writing in circular no. 19 of 7 August 2009: foreign citizens "do not lose their registration during the renewal of the residence permit". Bring to the office:

  • the receipt of the renewal application (from the post office or the immigration one-stop shop);
  • the expired permit, which shows that the application was filed in time.

With those two papers your position holds while the police headquarters do their work.

What cancellation actually means

Being cancelled from the registry is not a note in a file: it is being left without residence. It means not being able to renew your identity card, not being able to request certificates, losing your enrolment in the National Health Service and therefore your family doctor, and finding every procedure that asks for an address — from the bank to the school — suddenly complicated.

And there is a less visible damage that shows up years later: continuity of residence is what is looked at for the EU long-term residence permit and for the application for citizenship by residence. A gap of months in your registry history is a problem you meet much later, when you need to prove the years.

How to do it, in practice

  1. As soon as you collect the new permit, note the date. Sixty days run from there.
  2. Prepare the declaration with your details, the permit details and the address where you live.
  3. Attach a copy of the permit (both sides) and a copy of an identity document of yours.
  4. File it. At the registry counter, by registered post, or by email or certified email: in that case you sign the sheet by hand, scan it and send it with the copies, under article 38 of presidential decree 445/2000. The right addresses are published on your municipality's website.
  5. Keep the receipt or the confirmation email: it is your proof that you did it.

Many municipalities have their own printed form: if there is one, use it. There is no single national model as there is for the declaration of residence — what the law requires is the declaration, not a particular form.

Two things this declaration does not cover

  • If you have also moved house, this is not enough: you also need the declaration of residence for a change of address, which is a separate procedure.
  • If you are a citizen of an EU country, this rule does not apply to you: your case is governed by legislative decree 30/2007, which is a different matter.

The guided form in Bahay Italia

Inside Bahay Italia you find the renewal of the declaration of habitual residence among the guided forms: simple questions in your own language, every field explained as you fill it in, and at the end you download the declaration already written, with the list of what to attach and the ways to file it. If you have already filled in another form, your details are already in place.

We never ask you for a scan: you bring the copy of the permit to the counter yourself, or attach it to your own email.

This guide explains the national rule. Each municipality has its own hours, addresses and sometimes its own form: your municipality's website is where to check the details. If you have already received a cancellation notice, do not wait: go to the registry office, or get help from a CAF or a patronato.
